Welcome to Hair Root. These Terms of Service (the "Terms") govern your access to and use of hairroot.shop (the "Site") and any order you place with us. By using the Site or placing an order, you agree to these Terms. If you do not agree to them, please do not use the Site.

We may update these Terms from time to time. The version posted on this page at the time you place an order is the version that applies to that order.

1. Who we are

Hair Root ("we", "us", "our") operates hairroot.shop.

2. Eligibility

You must be at least 18 years old, or the age of majority in the place where you live, to purchase from this Site. By placing an order you confirm that you meet this requirement and that the information you give us is accurate and complete.

3. Our products are cosmetics, not medicines

This is the most important section on this page, so please read it.

Everything we sell is a cosmetic product intended for external use on the hair and scalp. Our products are not drugs. They are not intended to diagnose, treat, cure or prevent any disease or condition, including hair loss, alopecia, or any scalp condition. Statements made on this Site have not been evaluated by the U.S. Food and Drug Administration.

• Always read the product label and the instructions on the product page before use.
• For external use only. Keep away from the eyes. Keep out of reach of children.
• We recommend a patch test before first use, particularly if you have a sensitive scalp or known allergies.
• Stop using a product immediately if you experience irritation, redness, itching or any other adverse reaction, and seek medical advice if it persists.
• If you are pregnant or breastfeeding, have a diagnosed scalp or skin condition, or are taking medication, speak to a doctor or pharmacist before use.
• Individual results vary. Nothing on this Site is a promise of any particular result.

Nothing on this Site is medical advice, and we are not qualified to give it. We are not a substitute for a doctor, dermatologist or trichologist.

4. Product sets that include a micro-needle roller

Some of our product sets include a handheld micro-needle roller (a "dermaroller"). This is a skin-penetrating personal care device, not a comb or a scalp massager.

• It is not an FDA-cleared medical device, and we make no claim that it treats hair loss, thinning, or any other condition.
• It is for use by one person only, by adults aged 18 or over, on intact skin.
• Do not use it together with any serum, essence or spray. Micro-needling is not an approved route for delivering cosmetic products into the skin.
• Do not use it if you take blood-thinning medication, have a bleeding or clotting disorder, have a history of keloid scarring, have diabetes affecting wound healing, or are pregnant, unless a doctor has told you it is safe.
• Read the full safety information on the relevant product page before use, and follow the manufacturer's instructions supplied in the box.

If you choose to use a micro-needle roller, you do so at your own risk. If you are unsure whether micro-needling is appropriate for you, speak to a dermatologist first.

5. Orders and acceptance

Your order is an offer to buy. A confirmation email acknowledges that we received your order; it does not mean we have accepted it. A contract is formed only when we dispatch the goods.

We may refuse or cancel any order, in whole or in part, including where we suspect fraud, where an order appears to be placed for resale, where a product is unavailable, or where there has been an error in pricing or product information. If we cancel an order you have already paid for, we will refund you in full.

6. Pricing, taxes and errors

All prices are shown in U.S. dollars and may change without notice. Prices exclude shipping and any applicable taxes or duties, which are calculated at checkout or, for international orders, may be charged on delivery and are your responsibility.

Despite our efforts, a product on the Site may occasionally be listed at an incorrect price or with incorrect information. We reserve the right to correct any error and to cancel any order placed at an incorrect price, even after the order has been confirmed. If this happens we will contact you and refund you in full.

7. Product descriptions and images

We try to describe and photograph our products as accurately as we can. Colours and textures may appear differently on different screens, and packaging may vary from the images shown.

Some of our products are sold under the Hair Root brand while the physical item may display the manufacturer's original labelling. Where this is the case, we say so on the product page. Ingredient lists on the physical product take precedence over anything shown on the Site.

8. Shipping, returns and refunds

Our Shipping Policy and Refund Policy form part of these Terms and are incorporated by reference. Please read them before ordering.

9. Reviews and other content you submit

If you submit a review, photograph, comment or other content to the Site, you confirm that it reflects your own genuine experience of the product, that it is your own work or that you have the right to submit it, and that it is not unlawful, misleading, defamatory or infringing.

You grant us a non-exclusive, royalty-free, worldwide licence to publish, display, reproduce and adapt that content in connection with our business, including in marketing. You retain ownership of it.

We do not fabricate reviews, alter their substance, or suppress negative reviews in order to change the overall impression of a product. Where a reviewer has received a product free of charge or at a discount, we disclose that alongside the review. We may remove content that is unlawful, off-topic, abusive, or that we reasonably believe to be inauthentic.

10. Acceptable use

You agree not to use the Site for any unlawful purpose, to solicit others to perform unlawful acts, to infringe our or anyone else's intellectual property rights, to harass or abuse anyone, to submit false or misleading information, to upload malicious code, to scrape or harvest data, to interfere with the security features of the Site, or to attempt to gain unauthorised access to it. We may terminate your use of the Site for breaching any of these.

11. Intellectual property

The Site and its content — including text, product descriptions, photographs, graphics, logos and page design — are owned by us or our licensors and are protected by copyright, trade mark and other laws. You may not copy, reproduce, republish or exploit any part of the Site for commercial purposes without our prior written permission.

12. Third-party links and services

The Site may link to, or make available, content and services operated by third parties. We are not responsible for the content, accuracy, or practices of third-party sites and services, and their inclusion does not imply endorsement. Any dealings you have with a third party are between you and them.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Site and everything sold through it are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any result described on the Site will be achieved.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits your rights under mandatory consumer protection law in the place where you live.

14. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of your use of the Site or any product bought through it.

Where liability cannot be excluded, our total liability to you for any claim will not exceed the amount you actually paid us for the product giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

15. Indemnification

You agree to indemnify and hold harmless Hair Root and its officers, employees and agents from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

16. Governing law

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict of law rules. You agree that the state and federal courts located in Clark County, Nevada will have exclusive jurisdiction over any dispute arising from these Terms, except where the mandatory consumer protection law of your country of residence gives you the right to bring proceedings in your local courts.

17. General

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in force. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, form the entire agreement between you and us regarding your use of the Site. We may assign our rights and obligations under these Terms; you may not.
